Sir,
As you are aware, KVS has implemented the recommendations of 7th CPC in terms of GOI, D/o P&PW OM No. 38/37/2016-P&PW(A) dated 04.08.2016, 12,05.2017 & 06.07.2017. In this regard, KVS(HQ) has issued instructions to all the Regional offices/ZIETs for implementation of 7th CPC in all cases of employees retiring with effect from June,2018. Further, they have also been instructed to revise the pension in case of employees retired between 01.01.2016 to 31.05.2018. Therefore, you are instructed to make the payment of dearness relief as per the recommendations of 7th CPC in all the cases of pensioners retiring from 01.01.2016 and thereafter where the pension has been revised in terms of 7th CPC.
The necessary orders in this regard are as follows:
1. OM No. 42/15/2016- P&PW(G) dated 16 Nov, 2016.
(From 01.01.2016 Dearness Relief Nil, From 01.07.2016 – Dearness Relief- 2%)
2. OM No. 42/15/2016-P&PW(G) dated 7 Apr, 2017.
(From 01.01.2017 Dearness Relief 4%)
3. OM No. 42/15/2016-P&PW(G) dated 28 Sep, 2017.
(From 01.07.2017 Dearness Relief 5%)
4. OM No. 42/15/2016-P&PW(G) dated 22 Mar, 2018.

It is pertinent to inform you that KVS(HQ} has instructed to all the Regional offices/ZIETs to clearly depict in the PPO that the pension has been revised/calculated in terms of 7th CPC.
You are, therefore, requested to comply with the aforementioned orders for payment of dearness relief in all cases of Pensioners/family pensioners of Kendriya Vidyalaya Sangathan from 01.01.2016 and thereafter where the pension has been revised in terms of 7th CPC.
This issues with the approval of the competent authority.

SUB:   COMPUTATION OF COMMUTED VALUE OF PENSION FOR THOSE WHOSE BIRTHDAY FALL ON 1ST OF THE MONTH.
1. The Staff Side stated that Government employees whose birthday falls on the 1stof the month are retired on the last day of the previous month. In calculation of the commuted value expressed as number of year’s purchase, the age at the next birthday is taken into account. In case of those employees who retire on the last date of the previous month as their birthday falls on 1st of the following month, the next birthday after retirement will fall on 1stof the following month and his age on the date of next birthday is 60 Years and not 61 years. Therefore, his commutation value should be calculated at the rate of 10.13 and not@9.81.
2. The Official Side clarified that Rule 8 of the Commutation of Pension Rules, 1981 says that the commutation value shall be calculated in accordance with the Table of Value prescribed under Commutation Rules, on the date on which the commutation become absolute. As per Rules 6 (1)(i-a)  -In case of Government servant retiring on superannuation commutation become absolute on the day following the date of his retirement. Thus, in view of the above rules, in case of Government employees retiring on the last day of the previous month, the commutation becomes absolute on 1st of the following month. As such, he has already completed 60 years on 1stof the following month i.e. the date on which the commutation becomes absolute. Hence, the age next birthday will be 61 years. Therefore ,the commutation factor at the rate of 9.81 applicable to 61 years of age is correctly applied.

Raising concern over harassment of old parents by their children; the Delhi high court last week slapped a fine of Rs 1 lakh on a son for filing a case against aged mother over property dispute.
Justice Valmiki Mehta, who was hearing the case observed, The present is a classic case of aged parent being harassed by her children for property.
Obviously, it is not unexpected any longer from the people of this age, and is vividly depicted in a Hindi movie '102 Not Out'. The son filed an appeal against a trial court order, in which his sister filed a partition suit of their residence at Chitranjan Park, which was supported by the widowed mother.
In May, the trial court decreed the suit, and the son challenged it in the high court. The high court said that it failed to understand that how a son could dispute the grant of half ownership rights in a property by the husband to his wife.
"Even on merits, I fail to understand that how a son can dispute the grant of half ownership rights in a property by the husband to his wife, because even for the sake of argument, we take that the suit property was allotted to the husband because of being a displaced person on account of him having left a property in East Pakistan.
Surely, a husband can take an ownership of a property jointly with his wife, which means that he has gifted his half ownership rights in the suit property to his wife in this case," the court observed.
Terming the petition has completely frivolous, meritless and an abuse of the process of law, the court directed the man to pay the amount to his mother within six weeks. In a recent study released by Agewell Research and Advocacy Centre for the United Nations, it was found that 52. 4 per cent of the senior citizens faced elder abuse, mistreatment or harassment.
In May, the Delhi High Court had ticked off the Centre and the Delhi government, over delay in the functioning of Senior Citizens Maintenance Tribunal.
Acting Chief Justice Geeta Mittal and Justice C Hari Shankar had expressed their disappointment over inability of the government to effect the appointments to either maintenance tribunal or appellate tribunal, causing difficulty to the senior citizens.
The court was hearing a PIL seeking reconstitution of the tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, meant to protect the elderly from time consuming rigors of civil courts by providing speedy and inexpensive procedures.

RAIPUR: The National Confederation of Ex-Employees Association (NCEEA) of Central government public sector enterprises (PSEs) has expressed strong resentment over the U-turn by the central provident fund commissioner to defer action on extending the the Supreme Court's decision on enhancement of monthly pension of retired employees.
The NCEEA has called the directive of the commissioner of the Employees’ Provident Fund Organisation (EPFO) “unfair” and against the apex court's October 2016 order.
Aswatha Narayan, convener of the NCEEA, has sought the intervention of minister of state for labour and employment Bandaru Dattatreya and said the retired employees under EPS 95 scheme should not be forced to go for litigation and face contempt of court for not honouring the judgment.
The Supreme Court has ordered that the benefit of higher pensions be extended to pensioners, after seeking return of the amount the employees may have withdrawn from their PF account. “The ex-employees are willing to do it," said Narayan.
Lakhs of ex-employees (EPS-95 pensioners), who had retired from PSEs (including Navratna and Maharatna companies), felt they were deprived of their due after they had devoted their lives to build PSUs and actually given 8.33 per cent
of their salary to the Employers’ Contribution. “Why are retired employees deprived of dignified life by denying them suitable pension?” they asked.
“In March, the CEO of the EPFO issued a circular to  regional commissioners towards execution of the SC order. But on May 31, he abruptly decided to put his own order in a state of uncertainty on the pretext of seeking clarification from the EPFO’s central board of trustees. We are unable to understand the reason for denying the fair decision granted by the SC," said L M Siddiqui, general secretary, retired NMDC welfare association, Chhattisgarh chapter.
Siddiqui claimed that under the EPS-95 scheme there are around 55 lakh pensioners, of whom about 40 lakh are getting below Rs 1,500 per month and others a maximum of Rs 2,000-Rs 2,500 per month.

(a) whether the reports of successive Pay Commissions have been increasing the burden on Government finances/exchequer in partially accepting their recommendations for increase in wages and if so, the details thereof;

(b) whether the last Pay Commission has suggested productivity linked pay hike to the deserving employees to eliminate below average or mediocre performance and if so, the details thereof;

(c) whether such periodic hikes in wages resulting from Pay Commission recommendations trigger similar demands from the State Government/public utility employees, imposing burden on already strained State finances and if so, the details thereof; and

(d) whether the Government is considering an alternative for increasing the salaries and allowances of Central Government employees and pensioners in future instead of forming Pay Commission and if so, the details thereof?

ANSWER

(a) The financial impact of the recommendations of the Central Pay Commission, as accepted by the Government, is normally pronounced in the initial year and gradually it tapers off as the growth in the economy picks up and fiscal space is widened. While implementing the recommendations of the last Central Pay Commission, i.e., the Seventh Central Pay Commission, the Government staggered its implementation in two financial years. While the recommendations on pay and pension were implemented with effect from 01.01.2016, the recommendations in respect of allowances after an examination by a Committee have been implemented with effect from 01.07.2017. This has moderated the financial impact of the recommendations. Moreover, unlike the previous 6th Pay Commission, which entailed substantial impact on account of arrears, the impact in the year 2016-17 on account of element of arrears of revised pay and pension on the present occasion of the 7th Central Pay Commission pertained to only 2 months of the previous financial year of 2015-16.

(b) The Seventh Central Pay Commission in Para 5.1.46 of its Report proposed withholding of annual increment in the case of those employees who are not able to meet the benchmark either for Modified Assured Career Progression (MACP) or regular promotion within the first 20 years of their service.

(c) The service conditions of employees of State Governments fall within the exclusive domain of the respective State Governments who are federally independent of the Central Government. Therefore, the concerned State Governments have to independently take a view in the matter.

(d) No such proposal is under consideration of the Government.

Urinary Tract Infections (UTI) are a somewhat common infection among people of all ages and gender, and more so among women. This occurs when bacteria enter the urethra, the opening that carries the urine from the bladder. While men too, have UTIs, it is said that more than 10% of women over 65 and 30% of them over 85 suffer from UTIs. Without a doubt, age too is a factor and needs to be taken into consideration. Hence, understanding UTIs and taking steps for prevention, or getting proper treatment in the case of infection is very important. 
Symptoms
Typical symptoms of a UTI are:
  • Pain in the pelvis
  • Burning sensation in the urethra while passing urine
  • Frequent urination
  • Chills
  • Foul smelling urine
At times, you may also have a fever due to the infection, primarily if it spreads to the other parts like kidneys and bladder. Decreased appetite, lethargy, increased incontinence, back pain, nausea, etc. are also seen in a few cases. A bacteria called as Escherichia coli mainly causes the UTIIt is important to remember that not all people will have all the symptoms.
It has also been seen that at times, few seniors may be having atypical symptoms as well. So, when in doubt, if you find anything out of the ordinary happening, it is best to visit a doctor and get yourself checked. 
Seniors and UTI
The risk factor is more for seniors getting a UTI as the chances increase with age and age-related diseases like Alzheimer’s, Parkinson's or even diabetes. People wearing adult diapers and not maintaining hygiene are at a high risk of getting a UTI. Using a catheter is also one of the reasons for UTI. People with a family history of UTIs should also watch out for such symptoms and get help immediately.
Specifically for women, the chances of UTI increase during menopause because of estrogen deficiency. Estrogen helps fight and contain the UTI causing bacteria. For males, the reasons could also be a bladder or kidney stone, or enlarged prostate. 
When you have a doubt and find some symptoms, you should visit a doctor, and the doctor may advise a simple urine test to figure out if the infection is present. Once diagnosed, the doctor will prescribe a line of treatment which most often will involve antibiotics. Not getting timely treatment can cause severe issues and complications in the case of UTI. Hence, follow a policy of visiting a doctor, especially if you are in the risk category.
Prevention
While, timely treatments can help contain the UTI, as always prevention is the best care. Here are a few steps that can be taken to keep UTIs at bay.
1. Drink plenty of fluids – Fluids, especially water, is said to help flush out toxins from the body and hence, the more you drink water, the healthier you will be.
2. Hygiene – This is a significant factor in avoiding UTIs. It is important to wash your genital parts properly as well as your hands every time you use a toilet. This will help keep the infections at bay. If you are using incontinence briefs or diapers, please change it as and when required.
3. Avoid coffee and alcohol – These are irritants to the bladder and can cause or aid the infection-causing bacteria. So, it is better to avoid or control the consumption of these two items.
4. Not holding urine – It is important to urinate whenever you feel that there is a need and not hold it back for long hours. Holding it back can also cause UTI.
Way to go
In conclusion, UTI is something that is common, especially among the older population, especially women. However, with a few simple steps, it can be avoided. And in the worst case of getting infected, proper treatment can be sought, and people can lead a healthy life without any issues.

(b) if so, the details thereof and the number of complaints received by the Government against the Government officers of various departments/Ministries for under performance and delay in work;
(c) the steps taken by the Government to identify such dull officers and the action taken/proposed to be taken against such officers;
(d) whether the Government has decided to evaluate the performance of IAS officers at the higher level on the basis of their approach towards weaker sections of the society and the draft appraisal forms in this regard have been finalised and if so, the details thereof; and
(e) whether a letter has been written to Chief Secretaries of States and UT Governments in this regard and if so, the details thereof and the time frame fixed for implementing the procedure of appraisal?

(a) to (c): Review of performance of Government servants is an ongoing process under Fundamental Rule 56(j) and Rule 48 of Central Civil Services (Pension) Rules, 1972, [Click to  Read ] which provide that the performance of a Government servant on attaining a specified age or qualifying years of service is to be reviewed and he/she can be retired in public interest.The instructions on the procedure to be adopted and various aspects to be kept in view while conducting periodical review under provisions of the said rules have been issued from time to time.
As per available information provided by cadre controlling authorities, performance of a total of 25,082 Group ‘A’ and 54,873 Group ‘B’ officers has been reviewed up to May 2018; and provisions of Fundamental Rule 56 (j)/ relevant rules were invoked/ recommended against 93 Group ‘A’ and 132 Group ‘B’ officers out of these.
(d) and (e): Confidential Rolls (CRs) / Performance Appraisal Reports (PARs) of IAS officers are written for each financial year or as may be specified by the Government in the form and as per the schedule prescribed in the All India Services (Performance Appraisal Report) Rules, 2007.The appraisal form of IAS officers, inter alia, provides for comments on the overall quality of officers including areas of strength and his attitude towards weaker sections.

Subject: Facilities for Pensioners through ‘Web Responsive Pensioners Service’ (WRPS) of CPAO
Quick disposal of grievances of pensioners has been a top priority of CPAO. For this purpose, a Grievance Cell is already functioning in CPAO and grievances received through different modes are settled by it. So far, grievances not pertaining to CPAO directly but involving other agencies are being forwarded for final disposal to the concerned agencies i.e. Bank and PAO for necessary action.
In order to. provide better services CPAO developed Grievance Redressal and Monitoring System i.e. ‘Web Responsive- Pensioners Service’ (WRPS): a facility of online transfer of grievances lodged by .Pensioners on the CPAO website for early disposal and update thereon . Pensioners have the following facilities through WRPS on CPAO’s website:-
1. View and Download the Special Seal Authorities issued by CPAO in both fresh as well as revision pension cases.
2. Check the pension processing status
3. Check last 12 months pension payment information
4. Register grievances and check the status etc.
To facilitate pensioners, a step-by-step user guide along with relevant screenshots is attached for ready reference
The same may be given wide publicity for the benefit of the existing.pensioners as well as future retirees.
