(a) whether the Central Government Health Scheme (CGHS) and Rashtriya Swasthya Bima Yojana (RSBY) has been effective in reducing the burden of out-ofpocket spending of poor households;
(b) if so, the details thereof, if not, the reasons therefor;
(c) the total number of beneficiaries under CGHS and RSBY during the last four years, year-wise and State-wise; and
(d) the total funds allocated under the CGHS and RSBY to the beneficiaries in the country, State/UT-wise particularly in Bihar?

(a) & (b): Central Government Health Scheme (CGHS) is a contributory scheme primarily of Central Government Employees and Pensioners. CGHS subscribers are provided health facilities including OPD, medicines, reimbursement of expenditure incurred on hospitalization etc. On the other hand, Rashtriya Swasthya Bima Yojana (RSBY), which has now been subsumed in Ayushman Bharat-PMJAY, provided hospitalization cover of upto Rs. 30,000/- per Annum (on family floater basis) to upto 5 members of BPL and 11 other categories of unorganized workers’ families. No assessment to measure reduction in out of pocket spending of poor households by RSBY has been done by the Government.
(c): The number of CGHS beneficiaries during last four years is at Annexure-I. The total number of enrolled families under RSBY during the last four years year- wise and State-wise is at Annexure-II.
(d): Details of Funds allocated to CGHS Cities including CGHS, Patna, are at Annexure-III. There is no beneficiary wise allocation of Funds under RSBY by the Central Government. The details of funds released under RSBY State/ UT wise is at Annexure IV. No amount was released to Bihar during last four years.

(a) whether there is an acute shortage of doctors in the CGHS dispensaries across the country;
(b) if so, whether the Government has appointed retired doctors in the CGHS dispensaries, if so, the details thereof;
(c) whether the Government intends to appoint new doctors in the said dispensaries; and
(d) if so, the details thereof along with number of vacancies reserved for SCs/STs and if not, the reasons therefor?

(a) & (b): Yes, there is a shortage of Central Health Services (CHS) doctors in CGHS Dispensaries. For due patient care, retired doctors are engaged on contract basis against vacant posts of regular doctors as an interim measure. Presently, a total of 204 doctors have been engaged on contract basis in various CGHS dispensaries all over India.
(c) & (d): Government makes efforts on a continuous basis to fill up the vacant posts of doctors in CGHS dispensaries. For this purpose, requisition is sent to the Union Public Service Commission for recruitment of General Duty Medical Officers (GDMOs) through the Combined Medical Services Examination. The Reservation Roster for GDMO Sub-cadre of the CHS is maintained as per the reservation policy of the Government.

MINUTES OF THE 47th MEETING OF THE NATIONAL COUNCIL OF THE JOINT CONSULTATIVE MACHINERY(JCM) HELD ON 13th APRIL, 2019.
The 47th Meeting of the National Council (JCM) was held on 13th April, 2019 under the Chairmanship of Shri P. K. Sinha, Cabinet Secretary, at Rail Bhawan, New Delhi. A list of the representatives of Staff Side and Official Side who participated in the meeting is annexed.
2. At the outset, Secretary (Personnel) welcomed Cabinet Secretary and Chairman, National Council (JCM), the Leader of the Staff Side, the Secretary of the Staff Side, the Senior Officers from-different Ministries/Departments-and Members of-the Staff Side.
3. Thereafter, Cabinet Secretary and Chairman, National Council (JCM) extended a hearty welcome to the representatives of the Staff Side as well as the Official Side. He stated that there has been a long gap between the 46th and 47th meeting of the National Council. However, four meetings of the Standing Committee were held during the last four years. He thanked the Staff side for their cooperation for successful and smooth implementation of recommendations of the 7th CPC and further stated that Government of India have taken several new initiatives, such as maintaining 10% employees' contribution and increasing Government contribution from 10% to 14% in the New Pension Scheme(NPS), promotion of more than 4000 Central Secretariat Officers viz. Deputy Secretaries, Under Secretaries and Section Officers, increasing the duration of admissible maternity leave upto 6 months, employee friendly modifications to the CGHS and abolition of the interview for recruitment to Group 'B' and Group 'C' posts. He further observed that some of the agenda items of the 47th meeting are too old and may have thus lost relevance. He also stated that Staff Side should come up with new ideas for the welfare of the employees, and that National Council and the Standing Committee meetings must be held regularly in future. Chairman also emphasized on the need for all Departmental Council meetings to be held on a regular basis to remove the gap between the two sides as also to identify the issues which require further consideration, and desired that all Secretaries of the concerned Ministries/Departments should ensure regular meetings of the Departmental Councils.
4. Leader of the Staff Side thanked the Chairman for highlighting important initiatives of the Government and for the assurance to continue sustained dialogue through JCM. He highlighted following issues for consideration:-

6. Thereafter, the 36 agenda items for meeting of the 47th National Council and Action Taken Statement on 9 agenda items of the 46th meeting of the National Council, JCM held in 2010, were taken up for discussion department-wise, which are summarized below:-
6.1.2 Item no.13/19/NC-47 - Reimbursement of expenses on indoor treatment to pensioners living in non-CGHS towns
6.1.3 Item No. 16/19/NC-47 - Grant of Medical Advance to the Central Govt. employees.
6.1.4 Item No. 17/19/NC-47 - Reimbursement of additional charges paid on account of overstay in the hospitals.
6.1.5 Item No. 18/19/NC-47 - Reimbursement of Oxygen charges.
6.1.6 Item No. 27/19/NC-47 - Hospital Patient Care Allowance for C.G. employees working in hospitals.
6.1.7 Item No. 34/19/NC-47 - Fixing of CGHS rates applicable to the treatment and diagnostic procedure.
6.1.8 In conclusion of items of M/O H&W, Chairman observed that there were many demands for rationalization of the CGHS Scheme. He stated that besides the agenda items, there may be other issues as well which may require to be looked into by the Government. He suggested that the Staff Side may send all the points considered necessary for resolution to Secretary, MoHFW, who may take a meeting in a month's time.

6.6.4 Item no. 9/19/NC-47 - Denial of Parity in scales of pay to the workshop staff of Railway/Defence and Postal Department.
7. After detailed discussions on the agenda, the following important points were raised by Staff Side member of MoD:-
i) MoD has taken a decision to declare 289 items being manufactured in the Ordinance Factories as non-Core and to outsource the same, thereby affecting drastically the workload of Ordinance Factories. Moreover, MoD has decided to close down many Defence Establishments, rendering more than 31,000 employees surplus. These decisions are taken without any discussion with the Staff Side, in spite of the fact that there is a clear direction from the Cabinet Secretary that before taking such decisions, the views of Staff Side should be kept in mind.
ii) During the strike negotiations with recognized Federations, Department of Defence Production has agreed to consider the demand of Staff Side to allot salary expenditure separately to the Ordinance Factories and to de-link the same from the cost of OFB products. The issue is still remaining unsettled and Staff Side requested to settle the matter at the earliest.
Thereafter the following points were noted and summarized:
i) Regular meeting of the National Council, Standing Committee as well as Departmental Councils of the JCM may be held in order to have speedy resolution of issues concerning the employees.
ii) On the persistent demand raised by the Staff Side concerning unavailability of latest instructions/circulars issued by various Departments to the Staff Side, it was directed by the Chairman that steps should be taken by the Departments to ensure that copies of the latest OMs/Circulars are made available to the Staff Side on e-mail as well as by other means.
iii) The Chairman also directed the Official Side to ensure that all matters which require further examination as discussed in today's meeting should be taken up for resolution.
iv) The Chairman directed the official side to look into employee-specific grievances likely to arise due to implementation of decision of the Government to restructure the Printing and Stationery Department and Central Public Works Department.

This was followed by a briefing given by Shri Ajay Kumar, Secretary, Department of Defence Production about the work being done, including the important initiatives being taken, by the Ordnance Factory Board. He mentioned the efforts being undertaken to modernize the Board. It was also informed that a meeting of the Departmental Council would be held to discuss the issues of the Ordnance Factory Board with the Staff Side.

7. After detailed discussions on the agenda, the following important points were raised by Staff Side member of MoD:-
i) MoD has taken a decision to declare 289 items being manufactured in the Ordinance Factories as non-Core and to outsource the same, thereby affecting drastically the workload of Ordinance Factories. Moreover, MoD has decided to close down many Defence Establishments, rendering more than 31,000 employees surplus. These decisions are taken without any discussion with the Staff Side, in spite of the fact that there is a clear direction from the Cabinet Secretary that before taking such decisions, the views of Staff Side should be kept in mind.
ii) During the strike negotiations with recognized Federations, Department of Defence Production has agreed to consider the demand of Staff Side to allot salary expenditure separately to the Ordinance Factories and to de-link the same from the cost of OFB products. The issue is still remaining unsettled and Staff Side requested to settle the matter at the earliest.
Thereafter the following points were noted and summarized:
i) Regular meeting of the National Council, Standing Committee as well as Departmental Councils of the JCM may be held in order to have speedy resolution of issues concerning the employees.
ii) On the persistent demand raised by the Staff Side concerning unavailability of latest instructions/circulars issued by various Departments to the Staff Side, it was directed by the Chairman that steps should be taken by the Departments to ensure that copies of the latest OMs/Circulars are made available to the Staff Side on e-mail as well as by other means.
iii) The Chairman also directed the Official Side to ensure that all matters which require further examination as discussed in today's meeting should be taken up for resolution.
iv) The Chairman directed the official side to look into employee-specific grievances likely to arise due to implementation of decision of the Government to restructure the Printing and Stationery Department and Central Public Works Department.
8. This was followed by a briefing given by Shri Ajay Kumar, Secretary, Department of Defence Production about the work being done, including the important initiatives being taken, by the Ordnance Factory Board. He mentioned the efforts being undertaken to modernize the Board. It was also informed that a meeting of the Departmental Council would be held to discuss the issues of the Ordnance Factory Board with the Staff Side.

Revision of pension and family pension in favour of the pensioners who were receipt of compulsory retirement pension and compassionate allowance: Agenda Item 47th NC(JCM) Meeting

6.5 D/o Pension & Pensioners Welfare & D/o Financial Services:
6.5.4 Item No.25/19/NC-47 - Arbitrary orders denying revision of pension and family pension in favour of the pensioners who were receipt of compulsory retirement pension and compassionate allowance under Rule 40 and 41 of the Central Civil Services (Pension) Rules, 1972.
Staff Side stated that in terms of rule 40 & 41 of Central Civil Services (Pension) Rules, 1972, compulsory retirement pension and compassionate allowance are sanctioned and are revised at par with other pension. DoP&PW O.M. No. 38/37/08 - P&PW(A) dated 03.10.2008 has stated that there should not be any revision on the Compulsory Retirement Pension and Compassionate Allowance. Tills order will adversely affect the living standard of such retired employees.
Staff Side said that the order of the DOPT cited in the agenda amounts to imposition of further penalty on a person who has already been punished once. This apart, they said that in all the past revision of pensions effected by the successive Pay Commissions, such revisions had been granted to those compulsorily retired personnel. They added that it was for the Government to take a view in the matter whether the compulsorily retired personnel must be given the benefit of minimum pension revision or not.
Reply of the Official Side :
As per the orders issued after 5th and the 6th CPC, the pension of past pensioners was revised by consolidating the pre-revised pension, dearness pension, dearness relief, interim relief and fitment benefit. These orders further provided an alternate method according to which the revised pension will not be less than 50% of the minimum pay in the revised pay-scale.
Sanctity of the penalty of reduced pension in such cases would be lost if the benefit of modified parity was also extended to the pensioners drawing compulsory retirement pension/ compassionate allowance.
Hon'ble Kerala High Court, in its order dated 31.07 .2015 in OP(CAT) No. 108/2016, directed to grant pension based on the minimum pay in the revised pay- scale (modified parity). However, on the advice of the Department of Pensions, the Department of Posts filed SLP No. 6726/2017. After discussion on the issue, the Chairman asked the official side to re-look into the matter in the light of the submission of the Staff Side .

Procedure for recording date of birth on entering Railway service and its alteration – Master Circular.

Sub: Procedure for recording date of birth on entering Railway service and its alteration – Master Circular.
At present the orders relating to the procedure for recording date of birth on entering Railway service and its alteration are scattered in a number of office circulars/ orders issued from time to time. Consolidated orders on the subject of “Procedure for recording date of birth on entering Railway service and its alteration” updated till 01.06.2019 is as follows:-
Declaration of date of birth at the time of appointment:
1. According to the existing provisions, every person appointed to a service/post under the Government shall at the time of his/her appointment, declare the date of birth and it shall be accepted by the appropriate authority on production of confirmatory/documentary evidence such as a Matriculation Certificate or a Municipal Certificate. If the person is not able to produce such an evidence, he/she should be asked to produce any other authenticated documentary evidence, which could be the school leaving certificate, a Baptismal Certificate in original or some other reliable document. However, horoscope should not be accepted as an evidence in support the date of birth. (Nos. E(NG)II/70/BR/1 dated 03/12/71, Rule 225-RI and E(G)84/FR1/1 dated 12/12/85).
2. When a candidate is not able to produce a confirmatory documentary evidence or any other authenticated proof to the satisfaction of the appointing authority, he/she should be asked to produce an affidavit in support of the declaration of his/her age.
3. In the case of literate staff, the date of birth shall be entered in the record of service in their own handwriting. In the case of illiterate staff, the declared date of birth shall be recorded by a senior railway servant and witnessed by another railway servant.
4. When the year or year and month of birth are known but not the exact date, the 1st July or 16th of that month, respectively shall be treated as the date of birth.
5. In the case of Group ‘D’ employees, care should be taken to see that the date of birth as declared on entering regular service is not different from declaration expressed or implied given earlier at the time of employment, if any, as a Casual Labourer or as a substitute.
6. A person who is not able to declare his/her age at the time of entry into Railway Service should not be appointed.
7. It should be ensured that the date of birth at the time of entry into service is recorded invariably in Christian Era and wherever possible in Saka Era also, both in words and figures.
8. The source/basis on which the date of birth has been recorded in the Service Records of the employees at the time of entering service may be recorded below the date of birth recorded.
II. Procedure in regard to alteration of date of birth:
1. The date of birth as recorded in accordance with the rules shall be held to be binding and no alteration of such date shall ordinarily be permitted subsequently. It shall, however, be open to the President in the case of Group `A’ & ‘B’ railway servants and a General Manager in the case of Group ‘C’ & `Cr railway servants to cause the date of birth to be altered.
(i) Where in his opinion, it had been falsely stated by the railway servant to obtain an advantage, otherwise inadmissible, provided that such alteration shall not result in the railway servant being retained in service longer than if the alteration had not been made, or
(ii) Where, in the case of illiterate staff, the General Manager is satisfied that a clerical error has occurred, or
(iii) Where a satisfactory explanation (which should not be entertained after completion of the probation period of three years service, whichever is earlier) of the circumstances in which the wrong date came to be entered is furnished by the railway servant concerned, together with the statement of any previous attempts made to have the record amended, (Rule 225-RI).
2. As a one – time exception to the time limits laid down in para-II.1 above, the Railway employees in service on 03/12/1971 were allowed to represent their cases for alteration in the recorded date of birth latest by 31/7/1973. After 31/7/1973, no request for alteration in the recorded date of birth can be entertained if it has not been submitted before completion of the probation period or three years’ service, whichever is earlier. (E(NG)11/70/BR1 dated 4/8/1972).
3. It is clarified that the above time limits will not apply in the case of illiterate Group ‘D’ staff.E(NG)II/78/BR/12 dated 25/10/78 and E(NG)1/86/BR/7 dated 19/10/86).
4. Regarding alteration in the recorded date of birth of Group ‘C’ & ‘D’ railway employees, General Managers may re-delegate their powers under Rule 225.RI to their PCPO’s. It is clarified that these powers do not include the power to relax the time limits and other conditions stipulated, in Para II.1 above. (E(NG)II/71/BR/4 dated 16/7/71 and E(NG)I/82/BR/10 dated 4/11/82)
5. Where the date of birth in the Matriculation Certificate has been corrected by the State Education Authority at the instances of or on direction from the Court of Law, the requests for alteration in the recorded date of birth’ may be considered provided that where the Court was moved by the employee before 31/7/1973, he had also made representations to the Railway Administrations before 31/7/1973. It is, however clarified that though the request of the employee could be entertained it need not necessarily be accepted. Relevant considerations like why the employee could not move a Court before 31/7/1973, whether the employee had derived any advantage by declaring the original date of birth, which he would not have got as per the revised certificate and also whether the date recorded was as per Matriculation Certificate or on some other basis, will have to be kept in view by the PCPO before deciding the case in the light of the extant instructions. The reasons for accepting or rejecting the request should be recorded.

6. In the case of Railway Servants who had matriculated from the Calcutta and Patna Universities and whose dates of birth have been recorded as first day of the month on the basis of their ‘Matriculation Certificate indicating the age in terms of years and months only, the alteration in recorded date of birth in such cases may be made on production of satisfactory documentary evidence to support the fact that Calcutta/Patna University had been following, at the relevant time, the practice of indicating the age of a person in terms of years and months, as on 1st March excluding days and also an extract from the Birth Register indicating actual date of birth claimed by the employee. The power to decide such cases rests with the Principal Chief Personnel Officers. However, no change on the basis of these orders will be permissible in case of employees whose Matriculation Certificate also indicates the actual date of birth. III General:
(a) While referring to this Circular, the original letters referred to herein should be read for a proper appreciation. This Circular is only a consolidation to the instructions issued so far and should not be treated as a substitution to the originals. In case of doubt, the original circular should be relied upon as authority.
(b) The instructions contained in the original circulars referred to have only prospective effect from the date of issue unless specifically indicated otherwise in the concerned circular. For dealing with old cases, the instructions in force at the relevant time should be referred to, and
(c) If any circular on the subject, which has not been superseded, has not been taken into consideration while preparing this consolidated letter, the said circular, which has been missed through oversight should be treated as valid and operative. Such a missing circular, if any, may be brought to the notice of the Railway Board.

4. Regarding alteration in the recorded date of birth of Group ‘C’ & ‘D’ railway employees, General Managers may re-delegate their powers under Rule 225.RI to their PCPO’s. Where the date of birth in the Matriculation Certificate has been corrected by the State Education Authority at the instances of or on direction from the Court of Law, the requests for alteration in the recorded date of birth’ may be considered provided that where the Court was moved by the employee before 31/7/1973, he had also made representations to the Railway Administrations before 31/7/1973. It is, however clarified that though the request of the employee could be entertained it need not necessarily be accepted. Relevant considerations like why the employee could not move a Court before 31/7/1973, whether the employee had derived any advantage by declaring the original date of birth, which he would not have got as per the revised certificate and also whether the date recorded was as per Matriculation Certificate or on some other basis, will have to be kept in view by the PCPO before deciding the case in the light of the extant instructions. The reasons for accepting or rejecting the request should be recorded.

In the case of Railway Servants who had matriculated from the Calcutta and Patna Universities and whose dates of birth have been recorded as first day of the month on the basis of their ‘Matriculation Certificate indicating the age in terms of years and months only, the alteration in recorded date of birth in such cases may be made on production of satisfactory documentary evidence to support the fact that Calcutta/Patna University had been following, at the relevant time, the practice of indicating the age of a person in terms of years and months, as on 1st March excluding days and also an extract from the Birth Register indicating actual date of birth claimed by the employee. The power to decide such cases rests with the Principal Chief Personnel Officers. However, no change on the basis of these orders will be permissible in case of employees whose Matriculation Certificate also indicates the actual date of birth. (c) If any circular on the subject, which has not been superseded, has not been taken into consideration while preparing this consolidated letter, the said circular, which has been missed through oversight should be treated as valid and operative. Such a missing circular, if any, may be brought to the notice of the Railway Board.

(a) whether the Government proposes to enhance the contribution which is presently at 10 percent to National Pension System (NPS) to make the retirement income scheme more attractive;
(b) if so, whether the Government has notified this change;
(c) if so, the details thereof; and
(d) if not, the date proposed for the notification of the new scheme?
ANSWER

(a) to (c) Government has increased the mandatory contribution by Central Government from 10% to 14% of the basic pay+DA for all the Central Government employees covered under National Pension System Tier-I. The employees’ contribution rate would remain at the existing 10% of the basic pay+DA. This has been notified vide Gazette Notification No. 1/3/2016 PR dated 31.01.2019, and has come into force with effect from 01.04.2019.
(d) Does not arise in view of reply given to parts (a) to (c).

Subject: Setting up of NPS oversight mechanism.
The undersigned is directed to say that the Committee, as set-up by Department of Financial Services in terms of their OM No. 1/3/2016-PR dt. 21.10.2016 under the Chairmanship of Secretary (Pension) and comprising Secretary, Department of Financial Services and Secretary (Department of Personnel and Training), had submitted its report on 28.2.2018, containing its recommendations for streamlining implementation of the National Pension System (NPS).
2. One of the recommendations contained in para 8.7.1 of its report relating to grievance redressal is as under:-
“Three-tiered NPS oversight mechanism of the DDO/Head of Office, Joint Secretary (Admin)/Chief Controller of Accounts and the Financial Advisor set up vide Department of Expenditure’s OM No.1(2)/EV/2008, dated 03.02.2009 may be strengthened/streamlined to monitor grievances as well as timely registration and credit of contributions to subscribes’ accounts. Fresh instructions to this effect and for strict compliance of instructions may be issued by Department of Expenditure.”

In the OM of this Department No. 1(2)/EV/2008 dated 3.2.2009, it was provided, inter-alia, that Ministries/Departments may constitute a Committee headed by JS (Admin) and Principal CCA/CCA to monitor registration/regular upload of data and transfer of NPS contributions in respect of Central Government employees to ensure that no delay therein occurs. Subsequently, in terms of instructions of this Department vide OM No. 1(5)/EV/2011 dated 10.7.2011 the Committee was broad-based to include the concerned Financial Advisors and the said instructions dt. 10.7.011 also provided, inter-alia, that the implementation of NPS, with its various attendant parameters, in each Central Ministry/Department, shall be a “key performance area” of the Financial Advisors.
4. The Department of Pension and Pensioners’ Welfare, which is the nodal Department in respect of pension related matters of Central Government employees, is separately in the process of framing statutory rules to regulate the matters of National Pension System in case of Central Government employees. These Rules would also cover the issue relating to timely credit of contributions of Central Government employees and the Central Government, as deducted from the salaries of the concerned Government employee, to NPS architecture.
5. However, since timely credit of deduction made from the salary of Central Government employees towards their contribution to NPS, as also the applicable contribution of the Central Government, to the NPS financial architecture is of paramount importance for availability of due and timely returns thereon towards generation of pension corpus, it has been decided that a Committee in each Ministry/Department shall be constituted as under to ensure oversight over the NPS contributions crediting:-
(i) Financial Advisor – Head of the Committee(ii) Joint Secretary (Administration)(iii) Principal CCA/CCA(iv) The concerned Head of the office(v) The concerned DDO
6. The Committee shall be responsible for the following actions:-
(i) Ensuring that the contribution of employees and the Government are credited without delay to the NPS financial architecture both in case of existing employees and employees newly recruited from time to time and the existing system and procedure being followed for the purpose shall be monitored effectively to ensure that no delay in credit of the contributions takes place.
(ii) Ensuring that in case any grievance by any employee is received in regard to delay in credit of contribution, either directly from the employee or through PFRDA, the same has been looked into and disposed of in a manner to the satisfaction of the concerned employee.
(iii) Any other matter as having a bearing on the issue of crediting/remittance of NPS contributions.
(iv) The Committee shall devise its own mechanism as also appropriate checks & balances to ensure that NPS contributions are credited on time in respect of all employees under NPS system.
(v) The Committee shall meet at least once in 3 months to review the progress and in case any slippages are noticed, it shall take immediate corrective action. However, the concerned Principal CCA/ CCA shall keep a watch over the progress on a regular basis.
7. While the above Committee shall be set-up in each Ministry/Department, appropriate mechanism for keeping a watch in respect of attached and subordinate offices under that Ministry/Department shall be put in place by the concerned Financial Advisor, so that the overall oversight in respect of the entire Ministry/Department as a whole is exercised by the Committee as mentioned in para 5 above.
8. The concerned Financial Advisor shall send a status report every six month to the Department of Pension and Pensioners’ Welfare about the result of the monitoring carried out through the above oversight mechanism with concluding remarks whether the NPS contributions are being credited on time and in case of any slippages, the details of the action taken.

Highlights of Union Budget 2019
- ₹5 lakh minimum limit announced for taxpayers. In view of rising income levels, those in the ₹2-5 crore and ₹5 crore-and-above brackets will see increase in effective tax rate by 3% and 7%, respectively.
