BASED ON THE FEEDBACK FROM THE ENVIRONMENT, FOLLOWING MAJOR SIMPLIFICATION MEASURES WERE INITIATED TO ENHANCE THE CONVENIENCE OF VETERANS ON 23 JAN 2018.

Sir,
Greetings. Bharat Pensioners Samaj - Federation of over 700 affiliated /associated Associations of Pensioners' of Civil/ including Postal, Railways, Defence, State Governments, Statutory/ Autonomous Bodies and EPS'95 organized mass   DHARNA on this day the February 21st, 2018 at Ramlila grounds, New Delhi to draw your kind attention for sympathetic favourable resolution of following long pending just issues.

 1. EPS'95: Pensioners: Implementation of Bhagat Singh Koshiyari Parliamentary committee’s report regarding amendment to EPS 95:
Sir, Bhagat Singh Koshyari Parliamentary was constituted on the petition of Sh Prakash Javadekar then MP & Patron of EPS 95 Pensioners/family pensioners & Now Hon’ble Minister HRD in your Govt.. On 24.2.2014 in Dharna organized by Bharat pensioners Samaj in coordination with EPS 95 Pensioners National Co-ordination Committee. Sh Prakash Javedkar, then BJP MP & now Hon’ble Minister HRD, had declared, “If my party comes to power, Bhagat Singh Koshyari committee report shall be implemented in TOTO within 3 months”, Sir, now its going to be 4years since Sh Prakash Javedkar’s party is in power. The poor pensioners /family pensioners who relentlessly worked for your victory in 2014 are feeling cheated as implementation of Bhagat Singh Koshyari committee report is still not implemented. Bharat Pensioners Samaj appeal to you to full fill the promise without further delay;
ii). EPS' 95 pensioners are not being granted DR at all to negate the  inflationary affect neither they are being provided any  Health-Care facilities.  Bharat pensioners Samaj appeal to you to grant them full Dearness Relief  at par with other Central Govt Pensioners at least from the date of constitution of Bhagat Singh Koshyari committee and to provide full heath-care coverage honoring the judgement of the Hon'ble Supreme Court in the matter of Consumers Education & Research Centre And Others Vs Union of India ( AIR  1955- SC 922). Health of elderlies can hardly be ignored.

2.  Extension  of  benefit of 7th CPC and DR revision to the pensioners of all Autonomous Bodies & PSUs:
Sir, upto 6th CPC all benefits of pay commissions accepted recommendations s & Dearness Relief revision were granted to all autonomous bodies Pensioners along with working employees .7th CPC benefits though have been extended to working employees of all these bodies and pensioners viz.
i. Central Power Research Institute ,
ii.    Council of Scientific and Industrial Research,
iii.    Bureau of Indian Standards,
iv.    Coir Board ,
v. Khadi and Village Industries Commission,
vi. Indian Council of Agricultural Research (ICAR) ,
vii.Indian Council of Medical Research. But these benefits have not been extended to the pensioners of other autonomous bodies like  Coffee Board, Rubber Board, Tea Board, etc. This is unjust and discriminatory and violates Article 14 of the constitution. You are, therefore, requested to intervene and order extension of benefits of 7th CPC and DR revision uniformly to the pensioners of all autonomous bodies.

3.Extension of benefit of Honourable Supreme court judgements on service & pension  matters to all similarly placed persons without pushing each one of them to the court to seek redressal on the same grievance/issue :
Sir, as of now Honorable Supreme court judgements are extended only to appellants /litigants and each of the other similarly placed pensioner/family pensioner in the evening of their lives are being pushed to the courts seeking redress of the same issue/grievance inspite of supreme courts repeated pronouncements “ It is a settled principle of law that when there are similarly situated persons, the Government should on its own grant the same relief to the others and should not force similarly situated employee to approach the court".This is not only causing harassment to elderly but has made Govt as the largest litigant increasing avoidable workload on already over loaded judiciary.

It is therefore, appealed that through a general order it be made mandatory for all Ministries & Departments to extend the benefit of legally settled issue of Service and Pensionary matters to all similarly placed persons.

4. Restore option one for revision of pension of pre2016 pensioners as recommended by 7th CPC : Pensioners are anguished on denial of Option-1 recommended by 7th CPC for revision of pension on flimsy grounds that records of about 18% pensioners are not available. Records, wherever not traceable, can be reconstructed. It is unjust to deprive over 80% pensioners of the benefit for the sake of about 18%. It is requested to revisit the issue and to restore option one as a 3rd option.

5. Railways :
a) Issue of separate concordance table for working out notional pay as on 01.01.2016 for working out revised pension of Rly running staff (REF: RBE Letterno:13/2016 Pc VII No:90 D-43/34/2017- FCE)III Dt:24.01.2018 ) :

i) Sir, NOTIONAL PAY CONCEPT IS BASED ON THE ASSUMPTION THAT ALL THE EMPLOYEES RETIRED PRIOR TO JAN.2016 , WERE DEEMED TO BE IN SERVICE TILL JAN. 2016 AND THEIR NOTIONAL PAY IS CALCULATED FOR CALCULATING PENSION.

As per extant instructions, 30% pay element is reckoned for in service benefits and 55% pay element is reckoned for retirement benefits. How then the emoluments i.e. basic pay+ 55% which is worked out only for the fixation of pension at the time of retirement can be taken as reference pay for working out notional pay PC to PC. It appears that Directorate  of Pay commission, Railway Board has intentionally drawn this inference just to deprive Running staff of the benefit of 30% pay element for working out Notional pay  PC to PC. Bharat Pensioners Samaj appeal the issue be revisited to do justice to  Rlys running staff ;

b) Discrimination in Health-Care: As pointed out in earlier communication vide No SG /BPS /H/2017/5                    dated 25.12.2017 (copy attached), though both Rly Pensioners & central civil pensioners belong to Central Govt. Services, Central Govt Civil Pensioners are getting better health care facilities through CGHS than the Railway’s RELHS beneficiaries. Till date RELHS beneficiaries have not been issued smart cards similar to CGHS beneficiaries for cashless treatment in emergencies in empaneled hospitals. Recently a pilot project for issuing Smart cards only  in Metro cities & Delhi NCR is launched under ‘CTSE’ wherein additional amount of Rs 6000 to 30000/ is being demanded from RELHS beneficiaries who have already paid the prescribed amount at the time of their retirement or on their joining RELHS subsequently. Moreover, even all those who wish to join the scheme by paying additional amount are unable to do so because of several unresolved glitches in the scheme for registration.Bharat pensioners Samaj therefore appeal to you :

.i) To either merge RELHS with CGHS or to provide quality health care services at par to the beneficiaries of both the schemes;
ii) To provide without asking for any additional amount, Smart cards for cashless treatment in any empaneled hospital in the country to all the existing RELHS beneficiaries,;
c).    On Indian Railways Unmarried/Widow/Divorced Daughters and Handicapped dependent Children of pensioners and family pensioners are facing harassment & exploitation in getting pension sanctioned on their turn. No uniform procedure is being followed. Kindly prevail upon the Ministry of Railways to issue consolidate simplified instructions for the sanction of pension in time bound manner to Unmarried/Widow/Divorced Daughters and Handicapped Dependent Children of pensioners and family pensioner on their turn; and
 d).       Process of revision of PPOs of pre-2016 is very slow. So far not even 50% of revised PPOS have been generated. Moreover, not even 10% of PPOs generated so far have been actually dispatched to PDAs for payment. Kindly prevail upon Ministry of Railways to hasten the process so date super Sr citizens get the benefit during their life time.
6. Regarding State Pensioners: Presently there is no uniformity in the methodology for sanctioning pensionary benefits to the pensioners of State Governments relating to DCR Gratuity, Dearness Relief, age related additional pension, fixed Medical allowance etc. vis-a-vis Central Govt. pensioners. Pensioners are a homogenous class and any discrimination of pensionary benefits is uncalled for. Bharat Pensioners Samaj appeal to you to kindly ensure uniformity & equality.

With reference to the above subject the undersigned is to state that the payment of Conveyance to CHS doctors (GDMOs and Specialists) working in CGHS Wellness Centres for domiciliary visits and performing other official duties is governed by this Ministry’s OM No. A-45012/03/2008 —CHS-V dated 28'h April, 2009.
2. In this regard attention is drawn to the Circular No C.14019 /03/2013/CGHS-III  dated the 12'h April, 2013 and 23" October 2015 vide which certain instructions have been issued for claiming conveyance allowance for domiciliary visits to see patients by CGHS doctors. In this regard the undersigned is directed to state that the matter has been reviewed by this Ministry, in response to the representations received from CGHS doctors and  to state that it has now been decided, in supersession  of  the earlier  directives  that  for claiming the conveyance allowance by CGHS doctors that the instructions as contained in the OM No. A- 45012/03/2008  —CHS-V dated 28th April, 2009 shall be applicable and CGHS doctors shall submit a certificate as per Annexure ‘A’ (copy enclosed) for claiming the conveyance allowance. The instructions shall be applicable uniformly for CGHS Medical Officers regardless of  their posting in a Wellness Centre or a Central Government Hopsital or a medical college.

Sub: Implementation of pay fixation orders in terms of the Hon’ble CAT, Principal Bench, New Delhi’s order dated 6th March, 2017.
Reference is invited to Department of Expenditure Office Memorandum No. F No.8-11/2017-E.III(A) dated 7th February, 2018 issued in compliance of CAT New Delhi’s Judgement dated 6.03.2017.
It has been decided that consequent to implementation of 6th CPC w.e.f. 1.1.2006, Assistant Accounts officers of Central Civil Accounts Service shall be allowed minimum entry pay as applicable for direct recruits in the G.P. of Rs.4800/- i.e. Rs.18150/- (B.P.13350 + G.P. Rs.4800) from the date of their appointment on promotion. The re-fixation of pay would be of course admissible from the date of promotion in each of the individual cases. Further, they shall also be entitled to arrears arising out of pay fixation. But, no interest on payment of arrears will be admissible.
However, AAOs on such fixation will not be treated as direct recruits to the post of Assistant Accounts Officer.

SUBJECT: Regarding implementation of 13-digit numbering scheme for M2M communication.
1. It is intimated that DoT has convened a meeting on subject matter on 08.01.2018. During the meeting following decision has been conveyed regarding implementation of 13-digit numbering scheme for M2M communication:
1.1. It was decided that 13-digit M2M numbering plan will be implemented from 1st July 2018. From this date on wards, all new M2M mobile connections will be allocated 13-digit numbers only.
1.2. All TSP’s must ensure that their network elements including IT and other relevant systems are aligned with 13-digit numbering for M2M SIM’s before 1StJuly 2018.
1.3. The readiness of LI system has also to be ensured for 13-digit numbers before 1st July 2018.
1.4. Migration of existing 10-digit M2M numbers to 13 digits will start latest by 1 October 2018 and shall be completed by 31’t December 2018.
2. In view of above directions from DoT, the undersigned has been directed to request you to ensure the provision for 13-digit numbering scheme for M2M communication in all the equipment to be supplied/deployed against Phase VIII.4 project.

Sub: Earmarking of reservation quota for women.
At present, following reserved accommodation is earmarked for use of female passengers:- .
(a) In Sleeper Class coach reservation quota of 6 berths in Mail/Express trains for ladies irrespective of age travelling alone or in a group of female passengers.
(b) In all trains having reserved sleeping accommodation, a combined quota of six lower berths per coach in Sleeper class and 3 lower berths per coach each in AC 3 tier and AC-2 tier classes for Senior Citizens, Female passengers of 45 years of age and above and pregnant women. In case of Rajdhani, Duronto and fully it Conditioned/Express trains, the number of berths to be earmarked under this quota in 3AC is 4 lower berths per coach as against 3 lower berths per coach in normal Mail/Express trains.
2. The issue regarding earmarking of ladies quota in 3 AC class of Garib Rath Express trains has been examined and it has been decided to earmark a reservation quota of 6 berths in 3 AC class of these trains for exclusive use of female passengers irrespective of their a while travelling alone or in group of female passengers.
3. It has also been decided to modify the- logic of utilising accommodation earmarked under ladies quota as under:-
(i) Till preparation of first reservation charts, only female passengers travelling alone or in group of female passengers will be booked against this quota,
(ii) However, at the time of preparation of first reservation charts, the unutilised quota earmarked for female passengers will b released to waiting, Its female passengers travelling alone or in group of female passengers followed by waiting list senior citizens.
If there are no such passengers and berths are left vacant, on board ticket checking staff shall be authorised to allot this accommodation to any other lady passenger/senior citizen on partially confirmed ticket, if any after making necessary entries in the reservation chart.
4. CRIS will make necessary modification in the software and advise date of effect to all Zonal Railways as well as this office.
5. Necessary instructions may be issued to all concerned accordingly.

MINUTES OF THE MEETING HELD ON 11.01.2018 TO DISCUSS THE ADMISSIBILITY OF THE AGENDA ITEMS RECEIVED FROM THE STAFF SIDE FOR DISCUSSION IN THE NATIONAL ANOMALY COMMITTEE (NAC) FOR THE 7TH CENTRAL PAY COMMISSION
A meeting was held under the chairmanship of Shri G.D. Tripathi, Joint Secretary (Establishment), Department of Personnel & Training with the representatives of Staff Side of the National Anomaly Committee and senior officers from the other Ministries/Departments concerned at 3.00 p.m. on 11.01.2018 in Room No. 190, North Block, DoPT, New Delhi to consider the admissibility of the 18 itmes of anomaly forwarded by the Staff-Side of the National Council of JCM for settlement through discussion at the NAC constituted after the Seventh Central Pay Commission. The list of participants is at Annexure.
2. The Chairman welcomed the representatives of the Staff-Side of the National Anomaly Committee and asked Deputy Secretary (JCA) to briefly inform the participants the purpose for convening this meeting.
3. Deputy Secretary (JCA) informed that following the acceptance of the recommendations – to the extent they have been – of the 7th Central Pay Commission by the Government, the National Anomaly Committee has been constituted by DoPT. Subsequently, on receipt of a representation from the Staff Side, NC(JCM), the definition of what would constitute an anomaly has been revised and notified. Therefore, as per the revised scope of definition, anomaly will include the following cases;
a) Where the Official-Side and the Staff-Side are of the opinion that any recommendation is in contravention of the principle or the policy enunciated by the Seventh Central Pay Commission itself without the Commission assigning any reason;
b) Where the maximum of the Level in the Pay Matrix corresponding to the applicable Grade Pay in the Pay Band under the pre-revised structure as notified vide CCS(RP) Rules 2016, is less than the amount an employee is entitled to be fixed at, as per the formula for fixation of pay contained in the said Rules;
c) Where the Official side and the Staff Side are of the opinion that the vertical and horizontal relativities have been disturbed as a result of the 7th Central Pay Commission to give rise to anomalous situation.
4. Deputy Secretary (JCA) mentioned that a letter dated 16.08.2017 had been received from Secretary, Staff-Side proposing to discuss 15 items in the National Anomaly Committee (NAC). Subsequently, another letter dated 31.08.2017 was also received proposing 3 additional items. On examining these 18 items against the three (03) yardsticks as stated in para-3 above, it was felt that while some agenda items clearly fall within the definition of ‘anomaly’, there are a few which cannot be termed ‘anomaly’ as such, bordering more, as they are, on the side of ‘demands’. There are a few more which apparently by virtue of affecting the interests of one Department should rather be taken up at the Departmental Anomaly Committee. On sharing the findings of this Preliminary examination with the Secretary, Staff-Side, a communication was received from him suggesting inter-alia, besides giving their own reasons for retaining the same agenda – except one item – for the NAC deliberations, that a meeting be convened to discuss and finalize the items so as to to avoid delay in convening the NAC meeting.
5. The Chairman then requested the leader of the Staff-Side and other members to put across their points of view on the issue.
6. The Leader, Staff-Side, thanked the Chairman for convening the meeting at the suggestion of Secretary, Staff-Side and initiated the discussion by emphasising that the next meeting of the National Council under the Chairmanship of Cabinet Secretary should be held urgently as more than 7 years have passed since the last such meeting was held. He referred to the background against which the JCM scheme has been institutionalized and stressed that the purpose of JCM is to avoid confrontation between the Government and its employees. He requested that the sentiments of the Staff-Side may be conveyed to the Cabinet Secretary so that the meeting of the National Council, JCM may be held without any further delay. He also suggested that the Cabinet Secretary should meet the Standing Committee of the National Council, JCM soon after the Republic Day celebrations so that the deliberations can be be held on all pending issues. The Leader, Staff-Side further stated that there are many issues arising out of the 7th Central Pay Commission’s recommendations which are still to be settled to the satisfaction of the Staff-Side. He particularly mentioned about the recommendations relating to New Pension Scheme, Minimum Pay, Fitment Formula, etc.
7. Secretary, Staff-Side also expressed similar views about lack of interaction between the Official-Side and the Staff-Side. He mentioned that the institutions of JCM machinery has become defunct and stated that the meetings of the Standing Committee and the National Council, JCM should be called without any further delay. He also mentioned that the Group of Ministers had met the staff representatives and given some assurances for favourable consideration regarding the Minimum Pay and Fitment Formula. But even after 1-1/2 years, no decision has been conveyed by the Government. He regretted that inspite of the report submitted by NPS Committee, nothing fruitful has been done for bringing new pensioners under defined and guaranteed pension scheme. He stated that based on the assurance given by the group of Ministers, the Staff Side had deferred the call for strike but now it is getting very difficult for them to control the resentments of the staff. He stressed the need for frequent interactions so that each side can appreciate the other’s views. He also mentioned that no decision has yet been conveyed on the 6th CPC related unresolved anomalies which, the Staff-Side feels, should be sent for arbitration as the Staff-Side has recorded its dissatisfaction on them.

8. The Staff-Side members representing M/o Defence stated that they are on a hunger fast joining with the 4 lakhs Defence Civilian Employees to protest against the various decisions taken by Ministry of Defence against their interest. They lodged their protest aginst what they called ‘arbitary’ policy decisions made by the Government about outsourcing of jobs hitherto done in the ordince factories, converting Army Base Workshops to GOCO Model, closure of Station Workshops, Military Farms and Depots under Army Headquarters thereby rendering 31,000 Employees surplus including 9000 employees of Military Engineer Service, granting Uniform Allowance to the soldiers by stopping the practice of getting them stitched through almost 12000 Employees in 5 Ordnance Factories etc. This is against the assurance given by the Defence Ministry in the past to the Staff Side that the jobs being perfomed by ordnance factories would be outsourced. They also protested against the violation of the direction of Cabinet Secretary by the Ministry of Defence in that the Staff Side has not been consulted before deciding on outsourcing, closure, merger, declaring manpower surplus etc. They demanded that MoD may be directed to immediately hold discussions with the Staff Side and settle the issues in the interst of the Defence Industry and its employees

9. The Staff Side also raised the following issues:-
a) The demand of the Staff Side for extension of the date of option for switching over to 7th CPC Pay Scales from a date on which the employee got promotion/MACP is not yet settled. Necessary instructions may be issued in this regard.

b) The Report of the NPS Committee even though submitted to the Government in August, 2017 the Staff Side is not yet given a copy of the same. The same may be given to the Staff Side and a meeting may also be held with the Staff Side by the Government before taking any decision on the recommendations of the NPS Committee.

c) The Staff Side also pointed out what they felt arbitrariness of the decision of the Government to close down the various printing presses without even holding any discussion with the Staff Side. The employees have been asked to immediately get themselves, relived and join at faraway places. They added that assurances were given by the Cabinet Secretary at the National Council that the Government would discuss the problems faced by the staff and resolve the same in all cases when the Government decides to wind up any of its functions.

10. The Chairman stated that he has taken note of all the concerns expressed by the Leader, Staff-Side, Secretary Staff-Side and the other representatives of the Staff-Side. He stated that the work on finalizing the comments on the Agenda for the meeting with the National Council, JCM has been going on and another two weeks would be required to finalize the comments and thereafter the convenience of the Cabinet Secretary would be sought so that the meeting of the Standing Committee can be held in the month of February, 2018. He stated that the purpose of today’s meeting was to familiarize with the issues as well as to arrive at a mutually agreed decisions as to which of them should be taken up for discussion and settlement at the NAC so that the first meeting can be convened at the earliest. He further emphasised that the items on which the Government, has held a view different from that of the 7th CPC would not be taken up for discussion at the NAC since the Government decisions on them are well-thought-out and conscious ones. However, where there is a disagreement between what has been recommended and what the 7th CPC should have recommended as part of its policy/principles would figure in NAC discussion.
11. It was seen that there are seven (7) proposed items which clearly fall within the definition of ‘Anomaly’. At the conclusion of the discussions, the following was agreed to in respect of the remaining eleven (11) items:

12. Implement the recommendation on Parity in Pay Scale between Sr. Auditors / Sr. Accountant of 1A & AD and organized Accounts with Assistant Section Officer of CSS. As this was already under examination in the Department of Personnel & Training it would not be taken up for discussion in NAC at this stage. If it remains undecided at the later stage, it will be included for discussion in NAC.
13 Parity in pay scales between Assistants/ Stenographers in field/ subordinate offices and Assistant Section Offices and Stenographers in CSS The Staff-Side, NC (JCM) will provide additional details
15 Technical Supervisors of Railways The Staff-Side, NC(JCM) will take up this issue at the Departmental Anomaly Committee of Ministry of Railways.
16. Anomaly in the assignment of replacement of Levels of pay in the Ministry of Defence, Railways, Mines etc in the case of Store Keepers. The Staff-Side, NC (JCM) will take up this issue at the Departmental Anomaly Committee of Ministry of Defence. JCA Division will write to Ministry of Defence in this regard.
18. Anomaly in the grant of DA instalment w.e.f. 01.01.2016 In view of the response of Secretary, Staff-Side, the JCA Division will re-examine.

As per para 4.6.7 of the Accounting and Operating Procedure for Central Pension Processing Centre of Authorised Banks for Pension Disbursement to Central Government (Civil) Pensioners(February, 2012J wherein it has been provided that "the CPPC software will display on the computer screen, options and view of the details of calculation of pension and its breakup of the pension paid to the pensioner/ family pensioner. The Home Branch will act as intermediary with the CPPC and, besides providing accounts statement, provide to the pensioners the payment of TDS details, pension slip, the Due and Drawn Statement in respect of each arrear and the Annual Income Statement". These instructions have been reiterated vide this office OM No. CPAO/Tech/ Banks Performance/2015-76/60 dated-14.06.2015 followed by OM No. CPAO/ IT& Tech/ Banks Performance/20 !6-17 /220 dated-09.01.2017 and OM No. CPAO/ IT&Tech/ Clarification/ 13 [Vol-ltl)/2 076-77 /274 dated 31.03.2017 available on this office website w.cpao.nic.in.
Inspite of repeated instructions, it is observed that banks are still not giving The details of pension to the pensioners. Therefore, all Heads of CPPCs and Government Business Departments are once again advised to issue instructions to their branches to ensure that all pensioners are provided break up of payments made to them without fail.
This issues with the approval of Competent Authority.

MINUTES OF THE MEETING HELD ON 11.01.2018 TO DISCUSS THE
ADMISSIBILITY OF THE AGENDA ITEMS RECEIVED FROM THE
STAFF SIDE FOR DISCUSSION IN THE NATIONAL ANOMALY
COMMITTEE (NAC) FOR THE 7TH CENTRAL PAY COMMISSION
A meeting was held under the chairmanship of Shri G.D. Tripathi, Joint Secretary
(Establishment), Department of Personnel & Training with the representatives of Staff
Side of the National Anomaly Committee and senior officers from the other
Ministries/Departments concerned at 3.00 p.m. on 11.01.2018 in Room No. 190, North
Block, DoPT, New Delhi to consider the admissibility of the 18 itmes of anomaly
forwarded by the Staff-Side of the National Council of JCM for settlement through
discussion at the NAC constituted after the Seventh Central Pay Commission. The list
of participants is at Annexure.
2. The Chairman welcomed the representatives of the Staff-Side of the National
Anomaly Committee and asked Deputy Secretary (JCA) to briefly inform the participants
the purpose for convening this meeting.

3. Deputy Secretary (JCA) informed that following the acceptance of the
recommendations – to the extent they have been – of the 7th Central Pay Commission
by the Government, the National Anomaly Committee has been constituted by DoPT.
Subsequently, on receipt of a representation from the Staff Side, NC(JCM), the
definition of what would constitute an anomaly has been revised and notified. Therefore,
as per the revised scope of definition, anomaly will include the following cases;
a) Where the Official-Side and the Staff-Side are of the opinion that any
recommendation is in contravention of the principle or the policy enunciated by the
Seventh Central Pay Commission itself without the Commission assigning any reason;
b) Where the maximum of the Level in the Pay Matrix corresponding to the applicable
Grade Pay in the Pay Band under the pre-revised structure as notified vide CCS(RP)
